De website is eigendom van het commerciële bedrijf Bus Terrace Technologies SA., met hoofdkantoor in Via do Conhecimento, Edifício Central, Parque da Ciência e Inovação 3830-352 Ílhavo, Portugal, district Aveiro, gemeente Ílhavo, parochie Ílhavo (São Salvador), met collectief nummer 515274003 en dat op de markt opereert onder het merk LUGGit, hieronder zo aangeduid.
LUGGit is toegewijd aan transitactiviteiten en heeft een vergunning van het directoraat-generaal voor Landtransport (DGTT), vergunning nr. 901035.
Als transitbedrijf mag LUGGit alle noodzakelijke of handige handelingen verrichten om goederen ophaal- en bezorgdiensten te verlenen en in eigen naam of namens de klant of ontvanger van de goederen, elke vorm van zekerheid van de bijbehorende belangen aannemen.
LUGGit kan ook derden contracteren om de diensten uit te voeren en als manager op te treden.

Onderwerp en toepassingsgebied
Deze algemene voorwaarden zijn van toepassing op alle bezoekers (hierna gebruikers) van de LUGGit website en alle interacties die door hen worden gedaan, hetzij om een dienst aan te vragen (klanten) of om samenwerking met LUGGit aan te vragen (als een Keeper of een Partner).
Navigatie op deze pagina, of enige interactie, impliceert het begrijpen en accepteren van deze algemene voorwaarden.
Als u het er niet mee eens bent, dient u geen navigatie of interactie op de website te verrichten. Als u doorgaat met de navigatie, wordt elke vorm van interactie, voor alle wettelijke doeleinden, begrepen als volledige aanvaarding van de algemene voorwaarden. Daarom is het raadzaam om dit document zorgvuldig te lezen en in geval van twijfel onmiddellijk contact op te nemen met LUGGit via de hierboven aangegeven middelen.
LUGGit behoudt zich het recht voor om deze algemene voorwaarden zonder voorafgaande kennisgeving te wijzigen, en alle wijzigingen zullen op de website worden gepubliceerd.
LUGGit heeft alle inspanningen geleverd om ervoor te zorgen dat de informatie op de site vrij is van typografische of schrijffouten en, wanneer ze zich voordoen of worden ontdekt, zal LUGGit zo snel mogelijk overgaan tot de respectieve correctie.
LUGGit behoudt zich ook het recht voor om de gepresenteerde informatie over diensten, commerciële voorwaarden en partnerschappen te allen tijde te wijzigen.
Met betrekking tot Keepers en Partners is de verstrekte informatie van algemene aard en alle andere informatie zal worden verstrekt na de eerste interactie door LUGGit.
De reproductie, overdracht of opslag van de inhoud van deze pagina zonder voorafgaande schriftelijke toestemming van LUGGit is verboden voor andere dan strikt persoonlijke doeleinden.
Het is uitdrukkelijk verboden om links op deze pagina in te voeren, ongeacht het beoogde doel, zonder de voorafgaande toestemming van LUGGit. LUGGit is niet verantwoordelijk voor de inhoud van een van deze platforms of enig feit dat voortvloeit uit hun gebruik of weergave. Daarom is de verantwoordelijkheid voor het uitvoeren van alle noodzakelijke verificatieprocessen voordat u besluit of u ze wilt gebruiken of niet van de gebruiker. Er wordt geen aansprakelijkheid aanvaard voor enige schade of verlies die voortkomt uit het gebruik ervan. Wat betreft persoonlijke gegevens die op deze pagina kunnen worden verwerkt, raden wij u aan om het Privacybeleid te raadplegen.
Gebruikers die een link willen leggen tussen een pagina van hun eigendom en deze site kunnen dit doen door voorafgaande toestemming te verlenen via de hierin genoemde e-mail. Er zal alle informatie zijn met betrekking tot frauduleuze acties waarvan LUGGit op de hoogte is, gedaan door de derde partij op de pagina, die op enigerlei wijze de naam of afbeelding van LUGGit op een abusieve, illegitieme manier gebruikt. Om dit soort actie te helpen aanklagen en bestrijden, wordt u bedankt dat wanneer u op de hoogte bent van een frauduleuze actie van welke aard dan ook, u deze onmiddellijk aan LUGGit communiceert. In geen geval mag de gebruiker, die de ontvanger is van dit type actie, persoonlijke gegevens, in het bijzonder bankgegevens, openen, bevestigen of invoeren, noch zich abonneren op een voorgestelde service. De aanbeveling gaat dus in de zin van niet klikken op de bijbehorende links en geen externe pagina openen.
2. Intellectueel eigendom
Alle inhoud van de pagina, zoals teksten, grafische afbeeldingen, afbeeldingen, foto's, handelsmerken en andere, worden beschermd door auteursrecht en industriële eigendomsrechten en LUGGit, of andere entiteiten die de invoeging van hun inhoud op de site hebben toegestaan, worden beschermd.
Dergelijke inhoud mag daarom niet, geheel of gedeeltelijk, door technische middelen worden bewerkt of gereproduceerd, verwerkt, gewijzigd of overgedragen naar andere gebruiken, zonder de voorafgaande toestemming van LUGGit of andere entiteiten, houders van deze rechten, behalve voor de gegevens die worden beschouwd als vrij gebruik waarin wordt voorzien in de Code voor Auteursrecht en Naburige Rechten.
Daarom zal elk gebruik dat in strijd is met deze wettelijke bepalingen het onderwerp zijn van bevoegde procedures volgens de toepasselijke wetgeving.
3. Verantwoordelijkheid en gevallen van overmacht
LUGGit is niet verantwoordelijk voor enige interferentie, onderbrekingen, computervirussen, storingen of onderbrekingen van het besturingssysteem die tijdelijk de toegang tot navigatie of dienstverlening aan gebruikers kunnen verhinderen.
4. Verplichtingen van gebruikers
De gebruiker verbindt zich ertoe deze algemene voorwaarden na te leven, namelijk:
- Zich onthouden van het introduceren, opslaan of verspreiden via de site van lasterlijke, obscene, smadelijke, xenofobe en/of enige andere inhoud die de algemene beginselen van recht en openbare orde schendt;
- Geen valse identiteiten gebruiken en de vragen in de formulieren naar waarheid beantwoorden;
- Actuele persoonlijke gegevens verstrekken over de respectieve voorwaarden, zodat LUGGit verder contact kan leggen.
Het is gebruikers uitdrukkelijk verboden om berichten of informatie te gebruiken die schadelijk, misleidend, lasterlijk, obsceen kunnen zijn of op enigerlei wijze het recht op intimiteit of intellectueel of industrieel eigendom van derden of van de eigenaar van de website schenden.
LUGGit behoudt zich het recht voor om elke manifestatie van contact die via de webpagina wordt gemaakt te verwijderen als het reden heeft om aan te nemen dat de gebruiker een van de genoemde verplichtingen niet is nagekomen.
De gebruiker is verantwoordelijk voor de integriteit van de gegevens die aan LUGGit worden gecommuniceerd en verbindt zich ertoe om eventuele wijzigingen daarin te informeren.
5. Diensten
Elke gebruiker kan rechtstreeks op de website een transitservice boeken bij LUGGit door het bestaande formulier voor dit doel in te vullen. Door de boeking van de service te bevestigen, wordt de gebruiker een LUGGit-klant.
Tenzij anders schriftelijk overeengekomen, is de geleverde dienst onderworpen aan de volgende algemene voorwaarden uiteengezet in BIJLAGE I.
(Wanneer de klant twijfels heeft over hen, dient hij contact op te nemen met LUGGit, via de hier voor dit doel beschikbaar gestelde contacten. Er dient te worden opgemerkt dat de beschikbaarheid van de service altijd onderhevig is aan voorafgaande validatie door LUGGit)
6. Wees een Keeper
Om een LUGGit Keeper te worden, moet u zich vooraf registreren op de website, een kort formulier invullen en wachten op verder contact van het LUGGit team.
De contractuele voorwaarden van de Keeper zullen later door LUGGit aan u beschikbaar worden gesteld en na pre-registratie op de pagina.
7. Wees een Partner
Om een LUGGit Partner te worden, moet u zich vooraf registreren op de website, een kort formulier invullen en wachten op verder contact van het LUGGit team.
De contractuele voorwaarden van de Partner zullen later door LUGGit aan u beschikbaar worden gesteld en na pre-registratie op de pagina.

9. Toepasselijk recht
Deze algemene voorwaarden en alle geschillen die daaruit voortvloeien, inclusief hun geldigheid, worden uitsluitend en exclusief beheerst door het Portugese recht, dat bevoegd is om alle geschillen in de Portugese rechtbanken op te lossen, met uitdrukkelijke afstand van alle andere.
Als de gebruiker zich om welke reden dan ook buiten continentaal Portugal bevindt, LUGGit informeert dat alle gerechtelijke procedures moeten worden verwezen naar de Portugese rechtbanken.
10. Alternatieve geschillenbeslechting
In het geval van een consumentengeschil, gedefinieerd onder Wet nr. 144/2015 van 8 september, kan de consument gebruik maken van het verantwoordelijke alternatieve orgaan voor consumentengeschillenbeslechting.
Zonder afbreuk te doen aan de bepalingen van de wetgeving, statuten en voorschriften waaraan alternatieve entiteiten voor consumentengeschillenbeslechting zijn gebonden, zijn deze entiteiten bevoegd om consumentengeschillen te beslechten op de plaats van sluiting van het contract, of de beslechting gaat naar de entiteit met gespecialiseerde bevoegdheid, indien van toepassing.
LUGGit informeert dat als er geen alternatieve entiteit voor geschillenbeslechting is met jurisdictie op de plaats van sluiting van de dienstverlening of de bestaande(n) zichzelf niet als bevoegd beschouwt (beschouwen), omdat de waarde van deze laatste, de consument zijn toevlucht kan nemen tot:

Ownership of the website and company presentation
The website, is owned by the commercial company Bus Terrace Technologies SA., with headquarters in Via do Conhecimento, Edifício Central, Parque da Ciência e Inovação 3830-352 Ílhavo, Portugal, District of Aveiro, Municipality of Ílhavo, Parish of Ílhavo (São Salvador), with the collective No. 515274003 and which operates in the market under the brand LUGGit, being thus designated below.

Any User can book a transit service with LUGGit directly on the website by completing the existing form for this purpose. Confirming the booking of the service, the User will become a LUGGit Customer.
Except as otherwise agreed and in writing, the service provided is subject to the following Terms and Conditions set out in ANNEX I.

To become a LUGGit Keeper, you must pre-register on the website, answering a brief form and wait for further contact by the LUGGit team.

9. Applicable law
These Terms and Conditions and all disputes arising from them, including their validity, are governed solely and exclusively by the Portuguese Law, which shall be competent to resolve any disputes in the Portuguese courts, with express waiver of any others.
If the User is outside mainland Portugal, for any reason, LUGGit informs that any judicial proceedings must be referred to the Portuguese Courts.
10. Alternative dispute resolution
In the event of a consumer dispute, defined under Law No. 144/2015 of 8 September, the consumer may use the alternative consumer dispute resolution body responsible.
Without prejudice to the provisions of the legislation, statutes, and regulations to which alternative consumer dispute resolution entities are bound, these entities are competent to settle consumer dispute, at the place of conclusion of the contract or, alternatively, the resolution goes to the entity of specialized competence, if any.
LUGGit informs that, if there is no alternative dispute resolution entity with jurisdiction at the place of conclusion of the provision of the service or the existing one(s) does not consider itself to be competent(s), because the value of the latter, the consumer may resort to:
